Description: Following NACBA’s 33rd Annual Convention in Hollywood, this advanced session offers a focused examination of the U.S. Small Business Administration (SBA) as a creditor—particularly in light of the unprecedented volume of loans issued during the COVID-19 pandemic. With over 3.75 million Economic Injury Disaster Loans (EIDLs) totaling more than $377 billion, SBA loan issues are increasingly common in consumer bankruptcy cases. Even businesses that experienced a temporary boost from programs like EIDL and the Paycheck Protection Program (PPP) have faced long-term challenges, resulting in insolvency and bankruptcy filings.

This webinar will provide a deep dive into the types of SBA loans made, the unique ways SBA functions as a creditor, and the tools and strategies available to bankruptcy practitioners when addressing these obligations both in and out of court. Topics will include treatment of SBA debt in Chapter 7 and Chapter 13, administrative offset, SBA collection policies, and litigation trends.
